Inquiries


The EDPS conducts inquiries on his own initiative or on the basis of a complaint. He has extensive powers to access personal data, information and documents which are necessary for his inquiries and to access premises, in case an on the spot investigation is needed.
 
Inspections and other inquiries are essential for a supervisory authority to have the means for fact-finding, following up cases, monitoring issues of priority and to conduct audits. A systematic guide on inspections is being developed.
 
Aside from inquiries following a complaint, which may involve very specific matters, the EDPS conducts surveys on general issues as background information for preparing papers meant to give guidance to controllers on the processing of personal data. Some examples are:
  • e-monitoring;
  • personal files of staff;
  • video surveillance of buildings.

According to Article 41, paragraph 2 of Regulation (EC) 45/2001, the European Data Protection Supervisor is responsible for monitoring and ensuring the application of the Regulation. In March 2007, the EDPS launched a procedure known as "Spring 2007" as part of an effort to measure compliance with the Regulation in the various institutions and agencies and to take stock of the progress made so far.
