Annual appraisal procedure - CPVO

Opinion of 14 April 2008 on a notification for prior checking on the annual appraisal procedure (Case 2007-403)
The Community Plant Variety Office conducts an appraisal procedure every calendar year for each CPVO staff member concerned. The procedure is aimed at evaluating the staff members efficiency, abilities and conduct in service, identify training needs and is used as a career development tool which justifies the submission of the procedure to prior checking by the EDPS under Article 27 (2) (b) of Regulation 45/2001. The EDPS recommendations to be implemented by the CPVO includes, inter alia,
i) Adopt rules on retention of evaluation reports;
ii) Ensure that recipients are made aware that they shall process personal data only for the purposes they were transmitted for;
iii) Ensure that more specific and accurate information is provided to data subjects regarding the data transfer, right of data subjects, the right of recourse to EDPS and the data retention. The "CPVO appraisal guide" should therefore be amended.

Retirement without reduction of pension rights - Court of Justice

Opinion of 17 March 2008 on the notification for prior checking on data processing in connection with retirement without reduction of pension rights (Case 2007-579)

The purpose of the processing carried out by the Court of Justice is the implementation of the annual exercises for early retirement without reduction of acquired pension rights (application procedure and procedure for determining persons eligible for such retirement conditions).

The recommendations made by the EDPS mainly concern the following aspects: data storage, the information given to data subjects, and their rights of access and rectification, which also extend to the data subjects' family members.

Career development & appraisal cycle - EFSA

Opinion of 25 January 2008 on a notification for prior checking concerning "Career development and appraisal cycle" (Case 2007-585)

All officials, temporary and contractual agents engaged for a period of not less than one year by the European Food Safety Authority (EFSA) are subject to yearly evaluation reports concerning their ability, efficiency and conduct. The "Career development and appraisal exercise consists of two parts: firstly, the "development plan" which is prepared before the start of the reference period and includes the key objectives, performance indicators and development needs for the reference period and secondly the "final appraisal exercise" to be conducted at the end of the reference period.
 

The EDPS has issued an opinion on the evaluation of the EFSA staff. The EDPS concludes that on a general basis the procedure complies with the principles established in the data protection regulation. However the EDPS did make some recommendations mainly as concerns the need to provide appropriate information to the data subjects, to ensure the security of data during transfers as well as to remind all EFSA internal recipients of their obligation not to use the data for any further purpose beyond the purposes communicated to the data subjects.
