In der Datenschutz-Grundverordnung (DSGVO) sind Gesundheitsdaten als besondere Kategorie von Daten anerkannt. Zudem enthält sie eine Definition von Gesundheitsdaten für Zwecke der Datenverarbeitung. Zwar besitzen die mit der DSGVO eingeführten innovativen Grundsätze (Datenschutz durch Technikgestaltung oder das Verbot von diskriminierender Profilerstellung) auch in Bezug auf Gesundheitsdaten Relevanz und Gültigkeit, dennoch befasst sich der EDSB nun auch mit besonderen Garantien für personenbezogene Gesundheitsdaten und für eine endgültige Auslegung der Vorschriften, die einen wirksamen und umfassenden Schutz dieser Daten ermöglicht. Verfahren zur Förderung von Innovation und einer hochwertigeren Gesundheitsversorgung wie klinische Prüfungen und Mobile Health erfordern wirksame Datenschutzgarantien, um weiterhin das Vertrauen der Menschen in die Vorschriften, die dem Schutz ihrer Daten dienen sollen, zu gewährleisten.
