In der Charta der Grundrechte der Europäischen Union, die 2009 rechtsverbindlich wurde, sind die in der EU geschützten Grundrechte in einem einzigen Dokument niedergeschrieben. Diese Rechte, durch die Würde, Freiheiten, Gleichheit, Solidarität, Bürgerrechte und justizielle Rechte der Menschen in der EU gewahrt werden sollen, sind unveräußerlich und universell. Sie umfassen auch das Recht auf Schutz der Privatsphäre und das Recht auf Datenschutz, die die Grundlage für die Arbeit des EDSB bilden.
