Heute hat der Europäische Datenschutzbeauftragte (EDSB) eine Stellungnahme zu der Mitteilung der Kommission vom 20. Juli 2010 (*) angenommen, die einen umfassenden Überblick bietet über Instrumente der EU zur Regelung der Erhebung, Speicherung oder des grenzübergreifenden Austausches personenbezogener Daten zu Zwecken der Strafverfolgung oder Migrationssteuerung (Schengener Informationssystem, Eurodac und Beschluss von Prüm über den DNA-Datenaustausch sind Beispiele für solche Instrumente).

Heute richtete der Europäische Datenschutzbeauftragte (EDSB) einen Brief an die für Binnenmarkt und Dienstleistungen zuständige Generaldirektion der Kommission (GD MARKT), in dem er eine Bilanz dessen zieht, was erreicht wurde und welche weiteren Fortschritte in den im Bericht der Kommission über den Stand des Datenschutzes im Binnenmarkt-Informationssytem (IMI)^(*) angesprochenen Themen zu machen seien.

Der Europäische Gerichtshof hat sein Urteil über den sogenannte "Bavarian Lager"-Fall bekanntgegeben (*). Dieser Fall gilt als richtungweisend für die Frage, wie sich das Grundrecht auf Schutz der personenbezogenen Daten mit dem Grundrecht der Öffentlichkeit auf Zugang zu Dokumenten vereinbaren lässt.

Der Gerichtshof präzisierte bestimmte Schlüsselbegriffe der Verordnung über den Schutz personenbezogener Daten (**) und interpretierte die Verordnung über den Zugang zu Dokumenten (***) im Hinblick auf das Recht auf Schutz der Privatsphäre und Datenschutz.

Heute hat der Europäische Datenschutzbeauftragte (EDSB) eine Stellungnahme zum Abkommensentwurf der Europäischen Kommission mit den Vereinigten Staaten über das Programm zum Aufspüren der Finanzierung des Terrorismus (TFTP), um den US-Behörden Zugang zu den europäischen finanziellen Daten der belgischen Firma SWIFT in Falle von Anti-Terror-Ermittlungen zu ermöglichen, veröffentlicht (*).

Der Europäische Datenschutzbeauftragte (EDSB) hat gestern eine Stellungnahme zum Vorschlag der Europäischen Kommission veröffentlicht, die operativen Fähigkeiten der Europäischen Agentur für die Zusammenarbeit an den EU-Außengrenzen FRONTEX zu stärken (*). Die Stellungnahme konzentriert sich auf die laut Vorschlag wachsenden Aufgaben der Agentur und deren Konsequenzen für den Datenschutz.

Heute in einer Rede während der Europäischen Konferenz der Datenschutzbeauftragten in Prag sprach der Europäische Datenschutzbeauftragte (EDSB) Peter Hustinx eindringlich über die Notwendigkeit, im Rahmen der entfaltenden Debatte über die Zukunft des EU-Rechtsrahmens für den Datenschutz, pro-aktiv zu agieren.

Gestern nahm der Europäische Datenschutzbeauftragte (EDSB) eine Stellungnahme zum Vorschlag der Europäischen Kommission an, die Richtlinie über Elektro- und Elektronik-Altgeräte (WEEE, ebenfalls "e-Abfall" genannt)^(*) neu zu fassen. Dieser Vorschlag wird intensiv im Europäischen Parlament und im Rat diskutiert, aber ohne Rücksichtnahme auf Datenschutzauswirkungen.

The European Data Protection Supervisor (EDPS) adopted last week an opinion on "Promoting trust in the information society by fostering data protection and privacy" as an input to the forthcoming European Commission's new European Digital Agenda. The opinion discusses the measures that could be either undertaken or promoted by the European Union to guarantee individuals' privacy and data protection rights when making use of information and communication technologies (ICTs).

Today, the European Data Protection Supervisor (EDPS) issued a practical set of Guidelines to European institutions and bodies on how to use video-surveillance responsibly with effective safeguards in place. The Guidelines set out the principles for evaluating the need for resorting to video-surveillance and give guidance on how to conduct it in a way which minimises impact on privacy and other fundamental rights.

Following last week's agreement on the EU telecoms reform, nothing stands in the way for the ePrivacy Directive to enter into force. The formalities required for formal adoption will be undertaken in the coming weeks. The revised ePrivacy Directive^(*), as amended by the European Parliament and adopted by the Council must be implemented by the Member States within 18 months.

On 23 October, the European Data Protection Supervisor (EDPS), in cooperation with the European Network and Information Security Agency (ENISA), organised a seminar entitled "Responding to data breaches". The seminar, which was mainly aimed at data controllers and data security practitioners, was attended by more than 80 participants.
